Sauce Labs reserves the right to display attribution links such as “Powered by discuss.appium.io”, theme author and font assignment in your content footer or toolbar. Footer credits and the discuss.appium.io toolbar should not be removed, regardless of upgrades purchased. Scope of rights; Restrictions on Use. In accordance with the license granted herein, you may: (i) run the Licensed Program on Perfecto Mobile`s servers; and (ii) use the Licensed Program only within your organization and only to test and evaluate your own software and/or products in connection with third-party mobile phones, smartphones, and PDAs. You agree not to (i) reverse engineer, disassemble, decompile or attempt to derive the architecture, design or source code contained in the License Program, (ii) modify the Licensed Program, (iii) translate or otherwise use the Licensed Program, except as expressly permitted in this Agreement, or grant any person or entity the right to: to achieve any of the above objectives; (iv) sublicense, transfer and/or assign the Licensed Program to any third party, with or without consideration; (v) provide services to third parties using the Licensed Program (vi) allow third parties to use the Licensed Program. You may not make copies of the Licensed Program or any part thereof. The Licensed Program may now or in the future (after updates and/or upgrades thereto) contain or be derived from material licensed by third party licensors. Such Third Party Materials may be subject to the limitations set forth herein, which may be announced by Perfecto Mobile from time to time, and shall be deemed an integral part of such Materials for any purpose. Third Party Licensors are intended beneficiaries of this Agreement and may independently protect their rights to the Licensed Program (if and to the extent possible) in the event of infringement Appium was originally developed by Dan Cuellar in 2011 as “iOSAuto”, written in the C# programming language.    The program was released as open source in August 2012 with the Apache 2 license.   In January 2013, Sauce Labs agreed to fund the development of Appium and motivated the rewriting of the code using Node.js.   No competition; Your representatives. You represent and warrant that you are not a competitor of Perfecto Mobile and that you will not use the Service and/or the Licensed Program to compete with Perfecto Mobile or to enable others to compete with Perfecto Mobile.
You represent and warrant that: (i) you have reviewed the Service and/or the Licensed Program and found it appropriate for your needs; (ii) you are aware of and acknowledge the possibilities and limitations of the Service and/or the Licensed Program; (iii) You have all permissions and licenses, including applicable corporate policies, confidentiality and non-compete obligations, to upload Customer Data to the Service and use it through the Service. License. In consideration for paying the service and usage fees set forth herein and for performing your obligations hereunder, Perfecto Mobile grants you a non-exclusive, non-transferable, non-transferable, non-transferable and non-transferable license (the “License”) to use perfecto Mobile`s remote manual software and automated access to perfecto Mobile`s software/set of computer programs and data, listed in Appendix A. as they may be adapted, updated and/or updated by Perfecto Mobile from time to time, only in a machine-readable form, all subject to the following terms and conditions. These programs and data that may be updated and/or updated together form the “Licensed Program”, and in this context you may be referred to as the “Licensee”. This Agreement does not confer any title or ownership and does not constitute a sale of the rights to the Licensed Program.
